The High Court of Cassation and Justice admitted the appeal filed by the defendant pension authority, quashed the lower court’s judgment that had favored the claimant, and dismissed the action, thereby upholding the legality of the administrative decision denying benefits. The dispute concerned a challenge to an individual decision refusing recognition as a beneficiary under Law No. 189/2000 for victims of ethnic persecution; the material facts established that although the claimant’s parents fled during the 1940 Vienna Award period, the claimant was born in Alba Iulia in 1942, a territory that remained part of the Romanian state at that time. The decisive legal basis was the requirement under Law No. 189/2000 that beneficiaries must have suffered ethnic persecution in territories ceded from Romania, which the court determined did not apply since the claimant’s birthplace was not subject to such cession or resulting persecution.

Asupra recursului de față;
