The High Court of Cassation and Justice (Civil Section I) upheld its own jurisdictional exception and declined to hear the applicant’s request for case transfer (strămutare), ruling that the request must be decided by the Constanța Court of Appeal instead; no appeal is available. The applicant had sought to transfer a case pending before the Constanța Tribunal, citing legitimate suspicion (bănuială legitimă) without raising public-safety grounds. Applying Articles 131 and 142(1) of the Romanian Code of Civil Procedure, the Court held that requests based on legitimate suspicion fall within the jurisdiction of the court of appeal in whose circuit the lower court sits, whereas the High Court only hears transfer motions based on public-safety reasons; since the Constanța Tribunal lies in the Constanța Court of Appeal’s circuit, jurisdiction rests there, and the High Court’s declination leaves the Constanța Court of Appeal to resolve the transfer motion.

D E C I D E
