Jurisdiction over civil status rectification challenges: District Courts' competence under Civil Code and Administrative Litigation Law
Legislator summary
AI generatedThe High Court of Cassation and Justice granted the Prosecutor General's appeal in the interest of the law, establishing that matters of jurisdictional competence in civil status cases revert to the District Courts (judecătoria) for first-instance resolution, a decision that is binding on all courts under Article 517(4) of the Code of Civil Procedure. The legal dispute concerned whether civil actions challenging mayors' administrative decisions to correct civil status records (birth, marriage, death certificates) fell under the jurisdiction of the County Courts (contencios administrative) or the District Courts (civil competence). The Court resolved the jurisdictional conflict by applying a uniform interpretation of Article 58(5) of Law 119/1996, Article 100(2) and (4) of the Civil Code, and Articles 2 and 5 of Law 554/2004, determining that the nature of these requests for rectification is civil rather than administrative, thereby stripping the County Courts of subject-matter jurisdiction and assigning the cases to the District Courts.
