The High Court of Cassation and Justice admitted the referral from the Court of Appeal and issued a preliminary ruling, holding that under Article 96(2) of the National Education Law No. 1/2011, the local council’s representation on the administrative council of pre-university educational institutions with legal personality is not exclusively limited to a local councilor, and another natural person may be designated to represent it. The dispute arose from an administrative and fiscal case in which the court questioned the statutory interpretation of who may represent the local council in school administrative bodies. The ruling is binding pursuant to Article 521(3) of the Civil Procedure Code. Thus, the challenged restrictive interpretation was rejected, and broader representation is permitted.
