The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the General Prosecutor, issuing a binding interpretation that requires the inclusion of hazard pay for heavy, harmful, or dangerous working conditions when calculating the monetary rights due to prison police officers for their annual leave period, ensuring these benefits correspond to the time actually worked in such locations. This decision resolved a dispute concerning the uniform application of labor and public sector salary laws, specifically addressing whether risk-based surcharges must be integrated into annual leave remuneration for special-status public servants. The court’s ruling is grounded in the joint interpretation and application of Article 38(1) of Government Ordinance No. 64/2006 regarding the salary and other rights of special-status public officials in the penitentiary system, and Articles 150(1) and (2) of Labor Code No. 53/2003.
