The High Court of Cassation and Justice (Administrative and Fiscal Litigation Section) found as a matter of law that the petitioner's motion for annulment (contestație în anulare) against its earlier decision No. 1570 of 19 April 2018 (which had dismissed the petitioner's claim as inadmissible) was perimé (lapsed by operation of law) for remaining idle for more than six months through the petitioner's fault, and accordingly declared the motion perimated; the prior decision remains in force. The case arose from a procedural challenge in administrative litigation, where the court had suspended proceedings on 7 February 2019 due to the parties' unjustified absence under Article 411(1)(2) of the Civil Procedure Code, and the case was later reactivated to address the peremption exception. The court applied Articles 416(1), 416–418, and 420(1) of the Civil Procedure Code, holding that since no procedural act had interrupted or suspended the six-month limitation period, the motion was perimated as of right, with recourse available within 5 days of pronouncement.

Asupra contestaţiei în anulare de faţă;
