Admissibility of referral for interpretation of non-taxable limits on foreign business trip allowances and minimum wage inclusion
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the referral for a preliminary ruling as inadmissible, thereby denying the request for a binding interpretation and leaving the underlying dispute to be resolved by the lower court without a new directive. The case originated from a referral by the Alba Iulia Court of Appeal regarding the tax treatment of allowance payments received by employees on business trips abroad, specifically whether specific detachment allowances considered part of the minimum wage under the Law on Cross-Border Provision of Services fall within the non-taxable limits for such allowances. The decisive legal basis involved the interpretation of Articles 76(2)(k) and 76(4)(h) of the Fiscal Code regarding non-taxable income limits for travel allowances, in conjunction with Article 9 of the Law on Detachment of Employees in the Framework of the Provision of Services Across National Borders, and Article 521(3) of the Civil Procedure Code.
