The High Court of Cassation and Justice dismissed the underlying claim by holding that forestry personnel are not entitled to a professional grade allowance in the absence of specific legislative acts defining the method for calculating this salary component. The dispute, raised by the Ploieşti Court of Appeal in a fiscal administrative litigation context, centered on the interpretation of whether the statutory reference to a professional grade allowance for forestry staff was self-executing or required subsequent normative acts to be operational. Relying on Article 120, paragraph (4) of the Forestry Code (Law No. 46/2008), the Court established a binding interpretative precedent that the right to such an indemnity cannot be claimed unless the legislature has concretely regulated the establishment criteria and modalities of this specific salary benefit.
