Legislator summary

AI generated

The Constitutional Court dismissed the applicant's request to interpret Article 39(3) of the Criminal Procedure Code to extend judicial recusal to all members of a collective court. The applicant argued that the norm's prohibition on a judge being married to a judge in the same case should logically apply to the other two members of the collective bench, even without personal disqualification circumstances. The court rejected this, ruling that the statutory text and legislative intent limit the recusal mechanism strictly to the specific judge with the personal conflict, not the entire collective panel.
