ACÓRDÃO Nº 328/2017[1]

Acordam na 2.ª secção do Tribunal Constitucional

Proferido o Acórdão n.º 261/2017, verifica-se que o mesmo apresenta erro de escrita, suscetível de perturbar a compreensão da fundamentação.

Com efeito, em consonância com a reiteração do sentido decisório atingido pelo Acórdão n.º 577/2015, dele deveria constar que no presente recurso não se suscitam argumentos ou é afirmada de violação de parâmetros constitucionais não equacionados naquele aresto, ao invés da formulação empregue.

Determina-se, pelo exposto, nos termos do artigo 613.º, n.º 2, e 614.º, n.º 1, do CPC, a retificação do Acórdão n.º 261/2017, de modo a que, onde consta, no ponto 7, “nele sendo esgrimidos argumentos...” passe a constar “nele não sendo esgrimidos argumentos...”, fazendo menção ao presente Acórdão.
