The Constitutional Court rejected a request by appellants to clarify a lower court's judgment regarding court costs. The appellants argued the text was truncated and failed to mention that costs would not be payable due to their eligibility for judicial aid based on poverty. The court determined that no obscurity or ambiguity existed in the decision, citing established precedent that such requests require genuine textual confusion rather than mere omissions of known legal exemptions.

Portuguese Constitutional Court dismisses clarification request for civil court costs omission regarding legal aid.
103/96
Constitutional Court declares partial legal aid fee calculation rule unconstitutional for violating access to justice. The court ruled that requiring full fee disclosure in partial aid cases violates the right to access courts. The decision mandates reforming lower court decisions based on this unconstitutionality. The court found the specific statutory provision limiting fee calculation in partial aid cases unconstitutional. The ruling ensures that partial legal aid recipients are not penalized by excessive fee calculations. This case establishes that procedural rules must not effectively block access to justice. The court emphasized the constitutional right to access tribunals over formalistic fee requirements. The decision applies to cases where legal aid was granted only partially by lower courts. The court ordered the reform of the contested judicial decision to align with constitutional principles. This precedent clarifies the limits of fee calculation rules in legal aid contexts.

Acórdão 414/06

ACÓRDÃO N.º 414/2006

Processo nº 143/06
