The Constitutional Court dismissed a procedural attempt by a petitioner to block the remittance of a case to the Court of Appeal. The petitioner had previously exhausted remedies regarding the rejection of their appeal and lack of legal aid, yet sought to challenge these decisions again. The court determined that this strategy was fundamentally designed to obstruct the normal flow of proceedings rather than to raise a genuine constitutional issue.

Acórdão 594/04

ACÓRDÃO N.º 594/2004

Processo n.º 170/2004

2.ª Secção

Relatora: Conselheira Maria Fernanda Palma

Acordam em Conferência no Tribunal Constitucional

688 a fls. 893.
