Legislator summary

AI generated

The Constitutional Court granted the claim and ordered the appeal to proceed after reviewing the lower court's decision. The lower court had applied a normative criterion from Article 22 of the Urban Tenancy Regime (RAU) that aligned with the constitutional question raised. The Court found this interpretation procedurally adequate and rejected the argument that the rent deposit regime was merely accessory and outside the general urban tenancy concept.

Acórdão 419/04

ACÓRDÃO Nº 419/04

Processo n.º 449/03

Recorrentes: A. e mulher B.

Recorridos: C. e mulher D.

- Que é discernível no acórdão recorrido um critério normativo de decisão extraído do artigo 22º do RAU (Regime do Arrrendamento Urbano), aprovado pelo Decreto-Lei n.º 321-B/90, de 15 de Outubro, no essencial coincidente com a definição da questão de inconstitucionalidade contida no requerimento de interposição do recurso, que operou como ratio determinante da solução dada à causa;
