Acordam, na 3ª Secção do Tribunal Constitucional:

Nos presentes autos de recurso de fiscalização concreta de constitucionalidade, interposto ao abrigo do artigo 70º, n.º 1, alínea a), da Lei n.º 28/82, de 15 de Novembro, em que é recorrente o Ministério Público e recorridos A. e outros, o Conselheiro B., a quem o referido recurso foi distribuído, veio solicitar escusa, por entender que “[...] se coloca uma situação que poderia levar a gerar um sentimento de desconfiança sobre a sua isenção ou imparcialidade”.

Por isso, o Tribunal Constitucional decide deferir o pedido de escusa formulado pelo Exmo Conselheiro B..
