The Constitutional Court declared Article 120(1)(a) of the Penal Code unconstitutional when interpreted to allow notification of the accused to interrupt prescription. The prosecution argued this interpretation violated the Constitution by failing to consider the notification as a valid interruptive factor. The Court ruled that such an interpretation contradicts the principle of legal certainty and the nature of prescription, thereby invalidating the norm in question.
