Legislator summary

AI generated

The Constitutional Court dismissed the applicant's admissibility claim because they failed to constitute a lawyer within the prescribed deadline. The applicant argued that requiring legal representation violated Article 6(3)(c) of the European Convention on Human Rights and requested a preliminary reference to the Court of Justice. The court ruled that the applicant, litigating without counsel, could not be heard on the merits and thus could not take knowledge of the requested document.

Proc. nº 751/99

TC – 1ª Secção

Relator: Consº.
