Portuguese Constitutional Court upholds RAU Article 69(1)(a) as constitutional despite prior unconstitutionality ruling on descendants clause.
Legislator summary
AI generatedThe Tribunal Constitucional denied the public prosecution's appeal, confirming the constitutionality of Article 69(1)(a) of the Urban Leasing Regime. Although a previous decision declared this specific clause unconstitutional for violating the right to property, the court ruled that the new provision did not infringe upon the same constitutional rights. Consequently, the court applied the principle of non-retroactivity to the prior ruling, allowing the new norm to stand.
