The Constitutional Court rejected the applicant's request to clarify and reform a prior decision regarding the constitutionality of Article 68(1)(a) of the Criminal Procedure Code. The applicant argued that public crimes are unfairly shielded from private prosecution, claiming the court failed to balance criminal context with the principle of equality before the law. The court declined the request, upholding the original ruling that the state is the legitimate victim in cases of disobedience.

Acórdão 693/98

ACÓRDÃO Nº 693/98

Proc. nº 372/97
