The Constitutional Court of Portugal partially declared unconstitutional Article 6(1)(e) of Decree-Law 519-C1/79, confirming the lower court's decision but on distinct legal grounds. The Ministry of Public Prosecution challenged the norm, arguing it violated specific constitutional articles regarding labor rights and judicial independence. The court ruled that while the provision was not unconstitutional under the first set of arguments, it was found incompatible with the conjunction of Article 167(c) and other constitutional articles.
