Acordam na 1ª Secção do Tribunal Constitucional:

No presente processo, em que é recorrente o Ministério Público e recorrida F...., LDA, pelas razões constantes dos Acórdãos nº 271/93 (Acórdãos do Tribunal Constitucional, 24º volume, pág. 725), nº 280/94 e nº 31/96 (ainda não publicados), decide-se:

a) Julgar inconstitucional, por violação do disposto no artigo 168º, nº 1, alínea i), da Constituição, a norma constante do artigo 1º, alínea d), do Decreto-Lei nº 75-C/86, de 23 de Abril;

b) Consequentemente, negar provimento ao recurso.
