The Constitutional Court declared a specific tax appeal fee rule unconstitutional due to its violation of the right of access to courts. The Ministry of Public Prosecution challenged the rule, arguing it was necessary for fiscal order, while the applicant contended it created an insurmountable barrier to judicial review. The court ruled that the fee structure was disproportionate and effectively denied the applicant's fundamental right to challenge administrative decisions.
