Constitutional Court declares Article 3 of Decree-Law 199/90 unconstitutional for violating the right to asylum. The court ruled the norm invalid due to its incompatibility with constitutional asylum protections. This decision confirms the previous finding of unconstitutionality regarding the specific legal provision. The court emphasized that the norm failed to meet constitutional standards for asylum seekers. The ruling establishes that such laws must align with fundamental rights. The outcome reinforces the supremacy of constitutional asylum guarantees over administrative decrees. This case clarifies the boundaries of legislative power regarding immigration rights.
