The Constitutional Court declared the appeal against the Superior Council of the Judiciary moot and extinguished it. Although the applicant challenged specific articles regarding judicial election procedures, new elections had already taken place in the same year. Consequently, the court ruled that the legal challenge had become irrelevant and no longer served any practical purpose.

Acórdão 324/98

ACÓRDÃO Nº 324/98

Proc. nº 459/97

Cons. Messias Bento

Acordam na 2ª Secção do Tribunal Constitucional:

Recorrente: J...

a) o artigo 20º, nº 2, do Processo Eleitoral do Conselho Superior da Magistratura (aprovado em 15 de Julho de 1985 e publicado no Diário da República, II série, de 13 de Agosto de 1985, tendo sido alterado por deliberação de 22 de Novembro de 1994, publicada no Diário da República, II série, de 13 de Dezembro de 1994), que foi julgado inconstitucional pelo acórdão deste Tribunal nº 262/97, proferido nestes autos;

b) o artigo 164º, nº 1, da Lei nº 21/85, de 30 de Julho, interpretada "no sentido de ser a norma esclarecida e precisada pelo citado artigo 20º, nº 2 [...], e cuja inconstitucionalidade se lhe comunica";

Isto posto, o Tribunal decide julgar extinto o recurso.
