The Constitutional Court declared a specific tax appeal fee rule unconstitutional due to its violation of the right of access to courts. The Public Prosecutor challenged the rule derived from the 1990 Decree-Law and its annexed fee table, arguing it disproportionately hindered judicial access. The Court ruled that the fee structure failed the proportionality test, thereby invalidating the norm and confirming the lower court's rejection of the unconstitutionality claim.
