Legislator summary

AI generated

The Constitutional Court granted the claimant's request to file a constitutional appeal against a lower court decision. The lower court had implicitly applied Article 4(1)(c) of Decree-Law 138/85, which had been previously declared unconstitutional by the Constitutional Court in 1995. The court ruled that the lower court's failure to explicitly disregard the invalid norm rendered the decision legally flawed, necessitating the revocation of the original ruling to permit the constitutional challenge.
