Legislator summary

AI generated

The Constitutional Court decided not to examine the appeal filed by three individuals against a judicial decision. The applicants had previously invoked the relevant legal norms during their submission to the Supreme Court of Justice but did not formally raise the issue of unconstitutionality at that stage. The Court ruled that constitutional challenges must be raised before the Supreme Court, and failing to do so precludes direct access to the Constitutional Court.

ACÓRDÃO Nº 142/98

Proc. nº 791/97

2ª Secção

Relator: Cons.
