Nos autos à margem identificados, vindos do Supremo Tribunal Administrativo, em que é recorrente a CAIXA GERAL DE APOSENTAÇÕES e recorrido o MINISTÉRIO PÚBLICO, no essencial pelas razões constantes da exposição do relator - a que apenas respondeu a entidade recorrida, manifestando concordância com o juízo naquela formulado sobre a conformidade constitucional do art. 1º do Decreto-Lei nº 362/78, de 28 de Novembro - decide o Tribunal Constitucional negar provimento ao recurso.
