Acordam, em plenário, do Tribunal Constitucional:

Nos autos à margem identificados, em que é recorrente o MINISTÉRIO PÚBLICO e recorrido A., LDA. , decide-se, ao abrigo do disposto no nº 6 do art. 79º-D da Lei do Tribunal Constitucional, confirmar o acórdão nº 500/97, ainda inédito, para cuja fundamentação se remete, na parte em que não julgou inconstitucional a norma do nº l do art. 1º do Decreto-Lei nº 235/88, de 5 de Julho. No sentido deste acórdão pronunciou-se entretanto a 2ª secção do Tribunal, através dos acórdãos nºs 605/97 e 620/97, ainda inédito.
