Legislator summary

AI generated

The Constitutional Court declared Article 40 of the Portuguese Code of Criminal Procedure unconstitutional insofar as it allowed the intervention of the Public Prosecutor in reviewing a judge's preventive detention decision. The Court found this provision violated Article 32(5) of the Constitution by undermining judicial independence during the investigation phase. Consequently, the appeal confirming the constitutionality of the norm was rejected, leaving the original judicial decision intact.
