Acordam na 1ª Secção do tribunal Constitucional:

Nos presentes autos de fiscalização concreta da constitucionalidade, vindos do Tribunal Judicial de Paredes, em que figuram como recorrente o Ministério Público e como recorrido A., pelas razões constantes do Acórdão do Tribunal Constitucional nº 1223/96 (inédito, pelo que se junta cópia), decide-se não julgar inconstitucional a norma constante do nº 2 do artigo 10º da Postura sobre Sistema de Lixo e Higiene Pública, aprovada por deliberações da Assembleia Municipal, de 30 de Dezembro de 1987 e de 16 de Outubro de 1995, concedendo-se provimento ao recurso e revogando-se, em consequência, o despacho recorrido.
