Acordam na 2ª Secção do Tribunal Constitucional:

No presente processo, vindo do 5º Juízo Cível da Comarca de Lisboa, em que é recorrente o Ministério Público e recorrida a Companhia de Seguros A., S.A. , pelos fundamentos constantes dos Acórdãos nº 760/95 e nº 761/95 (publicados no Diário da República, II Série, de 2 de Fevereiro de 1996), decide-se conceder provimento ao recurso.
