The Tribunal Constitucional granted the public prosecutor's appeal against a lower court decision, reforming the judgment to align with its constitutional analysis. The court examined Articles 55(3) and 55(2) of Decree-Law 214/88, as amended by subsequent decrees, which govern administrative procedures. Although the lower court had found these norms unconstitutional, the Constitutional Court determined they were not in violation of the Constitution, thereby validating the statutory provisions.
