Legislator summary

AI generated

The Portuguese Constitutional Court denied the appeal against a decision refusing the unconstitutionality of Article 300(1) of the Tax Procedure Code. The Ministry of Public Prosecution sought to challenge the application of a prior ruling that had already declared this specific article unconstitutional with general binding force. The court ruled that since the unconstitutionality was already established and binding, the current decision correctly applied that declaration without needing further review.
