Legislator summary

AI generated

The Constitutional Court dismissed constitutional challenges filed against a court order for the execution of a debt. The underlying execution had been extinguished because the plaintiff had received payment from the insurance company before the constitutional review concluded. The court ruled that since the nature of these resources is instrumental, discussing the constitutionality of the decree became pointless after the debt was paid.

Acórdão 1116/96

ACÓRDÃO Nº 1116/96

Proc. nº 13/96

1ª Secção

Rel: Cons. Ribeiro Mendes
