Acordam na 2ª Secção do Tribunal Constitucional:

Nestes autos vindos do 1º Juízo do Tribunal de Círculo e de Comarca de Gondomar, sendo recorrente o Ministério Público, pelos fundamentos do Acórdão n.º 778/96 do qual foi junta cópia aos autos, estando em causa, como se referiu na Exposição de fls. 72, o artigo 55º n.º 2 e 3 do DL n.º 214/88, de 17 de Junho ( o n.º 2 na redacção do DL n.º 206/91, de 7 de Junho e o nº 3 na redacção do DL nº 312/93 de 15 de Setembro), decide-se conceder provimento ao recurso, determinando-se a revogação do despacho impugnando, a fim de ser reformado nos termos expressos no citado Acórdão n.º 778/96 quanto à questão de constitucionalidade.
