The Constitutional Court granted the public prosecution's appeal, overturning the lower court's declaration of unconstitutionality. The Ministry of Public Prosecution argued that Article 10 of the 1992 Decree-Law violated constitutional principles, while the Hospital de S. José defended the statute's validity. The court ruled that the norm does not infringe constitutional rights and therefore remains valid.
