Acordam na 1ª Secção do Tribunal Constitucional:

Nos presentes autos de fiscalização concreta de constitucionalidade em que figuram como recorrente o Ministério Público e como recorrido A., estando em causa a inconstitucionalidade material das normas contidas nos artigos 4º, 5º e 7º, do Decreto-Lei nº 404/93, de 19 de Dezembro (cuja aplicação foi recusada pelo tribunal a quo), pelas razões constantes do Acórdão nº 398/95 (ainda inédito e de que foi junta cópia aos autos), para que ora se remete, decide-se:

Conceder provimento ao recurso e, consequentemente, revogar o despacho recorrido.
