Legislator summary

AI generated

The Constitutional Court declared Article 207(1)(b) of the Military Code unconstitutional because it classified a civilian driver's negligent traffic offense as a military crime. The Ministry of Public Prosecution argued for the provision's validity, while the defendant contended it violated the principle of equality before the law. The court ruled that applying military-specific definitions to civilians in peacetime created an unjustified distinction, thus invalidating the norm.
