The Constitutional Court granted the appeal filed by the Public Prosecutor and the District Hospital against the insurance company's refusal to pay. The lower courts had dismissed the claim for damages arising from the hospital's liability, citing the insurer's contractual defenses. The court ruled that the appeal was procedurally valid and the initial decision required reconsideration based on the specific circumstances of the liability case.
