The Tribunal Constitucional granted the appeal against the unconstitutionality of Article 18(3)(d) of Law 7/92, declaring the norm constitutional. The Ministry of Public Prosecution challenged the provision following the precedent set in Acórdão 681/95, while the relator initially opposed the decision.
