The Constitutional Court granted the appeal against a judicial decision, ordering the reform of the lower court's ruling. The Ministry of Public Prosecution and a district hospital sought to recover funds paid to an insurance company, which had been made following a declaration of unconstitutionality. The court ruled in favor of the insurers, establishing that the state must reimburse the private entity for costs incurred due to the invalidity of the public payment.
