Acordam no Tribunal Constitucional:

Nos presentes autos de fiscalização concreta de constitucionalidade em que figuram como recorrente o Ministério Publico, e como recorrido A, pelas razões constantes da exposição do relator a fls. 49 e ss, que aqui se dão por acolhidas, decide-se conceder provimento ao recurso e, em consequência, determinar a reforma da sentença impugnada em consonância com o julgamento da questão de constitucionalidade.
