The Constitutional Court granted the appeal filed by the Hospital District of Abrantes against a lower court decision. The hospital argued that it should bear liability for damages caused by medical staff, while the opposing party contested this allocation of responsibility. The court ruled in favor of the hospital, establishing that the entity is liable only when there is a direct fault attributable to the institution itself.
