Acordam na 2ª Secção do Tribunal Constitucional:

Nos presentes autos, vindos do Tribunal Judicial de Tomar, em que figuram como recorrentes o Ministério Público e o Hospital Distrital de Tomar e como recorrida a Companhia de Seguros A., tendo como objecto a questão da constitucionalidade das normas constantes dos artigos 2º, nº 2, alínea a), e 4º do Decreto-Lei nº 194/92, de 8 de Setembro, pelos fundamentos dos Acórdãos deste Tribunal nºs. 760/95 e 761/ 95, publicados no Diário da República, II Série, n° 28, de 2 de Fevereiro de 1996, decide-se conceder provimento ao recurso e, em consequência, revogar a decisão recorrida, que deve ser reformada em conformidade com o aqui decidido quanto à questão de constitucionalidade.
