Portuguese Constitutional Court declares 1937 deportation laws unconstitutional for violating judicial function reserve.
Legislator summary
AI generatedThe Constitutional Court declared specific articles of the 1937 Decree-Laws on deportation unconstitutional due to their violation of the principle of judicial function reserve. The Ministry of Public Prosecution challenged these provisions, arguing they infringed upon the exclusive power of the judiciary to adjudicate legal disputes. The court ruled that the administrative nature of these laws deprived individuals of access to a judicial tribunal, thereby nullifying the statutes and dismissing the appeal.
