Legislator summary

AI generated

The Constitutional Court declared unconstitutional a specific provision in the Expropriation Code that denied compensation for direct legal servitudes. The Ministry of Public Prosecution challenged the rule, arguing it violated constitutional rights to property and fair compensation. The court ruled the provision invalid because it failed to require a direct legal basis for the servitude, even when the remaining property retained building potential.
