Legislator summary

The Constitutional Court upheld the constitutionality of Articles 4, 5, and 7 of Decree-Law 404/93 regarding deportation. The Ministry of Public Prosecution challenged these norms, arguing they violated constitutional principles by failing to consider the individual's public order status. The court rejected this argument, ruling that the statutory framework correctly balances state security with individual rights without requiring a separate public order assessment.

Legislator headnote

Art. 26.º da CRP; Art. 13.º da CRP: The statutory provisions governing deportation do not violate constitutional guarantees when they establish clear criteria for removal based on national security and public order, as the legislature has the authority to define these parameters without needing case-by-case judicial review of the individual's specific public order status.
