Constitutional challenge dismissed due to subsequent amnesties rendering the legal question moot.
Legislator summary
AI generatedThe Constitutional Court declared the unconstitutionality challenge against Article 27 of Decree-Law 30/89 extinguished because the underlying offense was subsequently amnestied. The Ministry of Public Prosecution and the defendant A. argued regarding the validity of the norm, but the court found the issue resolved by a prior judicial decision applying Article 1(f) of Law 15/94. Consequently, the court ruled the constitutional question moot and the appeal inadmissible due to supervening utility.
