Nos presentes autos, vindos do Tribunal Judicial da comarca de Vila Franca de Xira, em que é recorrente o Ministério Público e recorrido A., pelos fundamentos constantes do acórdão deste Tribunal Constitucional nº 397/95, de que foi junta fotocópia aos autos, aos quais no essencial se adere, decide-se conceder provimento ao recurso, assim se determinando a revogação do despacho sindicado, a fim de o mesmo ser reformado em consonância com o presente juízo sobre a questão de constitucionalidade.
