The Constitutional Court declared specific provisions of two decrees unconstitutional as they barred foreign asylum seekers from challenging their rejection of asylum with legal aid. The Ministry of Public Prosecution challenged these rules, arguing they were necessary for administrative efficiency, while the applicant contended they violated constitutional rights. The court ruled that denying legal aid to those contesting asylum decisions violated the Constitution's guarantee of effective judicial protection and the right to a fair trial. Consequently, the court struck down the ban while upholding the rest of the challenged legislation.
